Certain features of the Site and Services may be subject to additional guidelines, terms, or rules, which will be posted on the Site or provided in connection with such features. All such additional terms, guidelines, and rules are incorporated by reference into these Terms.

THESE TERMS OF USE (“TERMS”) SET FORTH THE LEGALLY BINDING CONDITIONS THAT GOVERN YOUR USE OF THE SITE AND ALL PRODUCTS, SERVICES, ASSESSMENTS, COACHING PROGRAMS, DIGITAL CONTENT, AND OFFERINGS PROVIDED BY TILTING THE BALANCE, LLC.

By accessing or using the Site or Services, you agree to be bound by these Terms on behalf of yourself or any entity you represent. You represent and warrant that you have the full right, power, and authority to enter into these Terms.

YOU MAY NOT ACCESS OR USE THE SITE IF YOU ARE UNDER 18 YEARS OLD.

THESE TERMS INCLUDE A BINDING ARBITRATION AGREEMENT AND CLASS ACTION WAIVER (SEE SECTION 21). These provisions affect your legal rights. Please review them carefully.

8. PURCHASES, PAYMENTS, SUBSCRIPTIONS, AND TAXES

8.1 Purchases

Purchases of physical books, digital workbooks, courses, coaching, assessments, memberships, and merchandise are governed by our Refunds, Returns, and Guarantees Policy, incorporated by reference.

8.2 Payment Processing

Payments are securely processed through Stripe or PayPal. We do not store full credit card information.

8.3 Subscriptions and Memberships

If you enroll in subscription-based programs:

• You authorize automatic recurring billing

• You may cancel before the next billing cycle

• Fees already charged are non-refundable unless explicitly stated

8.4 Taxes

You are responsible for applicable taxes on purchases.

9. USER CONTENT

9.1 User Content Defined

This includes messages, uploads, comments, reviews, assessments, survey responses, and materials you provide.

9.2 License to Company

By providing User Content, you grant us a worldwide, irrevocable, perpetual, royalty-free license to use, reproduce, modify, display, distribute, and create derivative works from your content for business, educational, or marketing purposes.

We will never publicly disclose private information without consent.

9.3 Prohibited User Content

You may not upload content that is:

• Illegal, abusive, fraudulent, defamatory, or harmful

• Infringing on intellectual property rights

• Malicious or harmful to Site operation

We may remove or block content at our discretion.

10. INTELLECTUAL PROPERTY

All content on the Site, including the Tilting The Balance™ framework, books, workbooks, courses, graphics, logos, videos, designs, and coaching methodologies, is owned or licensed by the Company.

• You alone are responsible for your choices and outcomes

We are not liable for any damages arising from use of our content or Services.

14. NO GUARANTEES OF RESULTS

Individual results vary.

• Transformations

• Earnings

• Health improvements

• Career outcomes

• Relationship outcomes

• Emotional or mental changes

• Any tangible or intangible results

Your results depend 100%, solely, and entirely on your independent actions, commitment, and personal circumstances.

15. ELECTRONIC COMMUNICATIONS

By using the Site or submitting your contact information, you consent to receive electronic communications, including:

• Emails

• SMS/text messages

• Portal messages

• Notifications

You may opt out of marketing messages at any time.

16. INTERNATIONAL USERS

The Site is operated from the United States.


If you access the Site from another country, you consent to the transfer and processing of your information in the U.S. under U.S. law.

You agree to indemnify, defend, and hold harmless Tilting The Balance™, LLC and its officers, employees, contractors, and partners from all claims, liabilities, losses, damages, and expenses arising from:

• Your violation of these Terms

• Your User Content

• Your participation in coaching

• Your violation of any rights of a third party

21. DISPUTE RESOLUTION, ARBITRATION, AND CLASS ACTION WAIVER

All disputes arising out of these Terms or your use of the Site will be resolved exclusively through binding arbitration in Jacksonville, Florida.

You agree to:

• Waive the right to a jury trial

• Waive the right to participate in a class, collective, or representative action

• Only individual arbitration is permitted.

22. GOVERNING LAW

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

23. ASSIGNMENT

We may assign or transfer these Terms at any time.

You may not assign your rights without our written consent.

24. SEVERABILITY

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect.

25. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, Refunds Policy, Shipping Policy, and any additional agreements incorporated by reference, constitute the entire agreement between you and the Company.

26. WAIVERS

26.1 No Waiver of Rights


No waiver by the Company of any term or condition set forth in these Terms shall be deemed a continuing waiver of such term or condition, nor shall any failure or delay by the Company to enforce any provision of these Terms be considered a waiver of the Company’s right to do so at any time.

26.2 No Implied Waiver

Any failure by the Company to assert a right or enforce an obligation under these Terms shall not constitute a waiver of such right or obligation.

26.3 Written Waivers Only

A waiver is only valid if it is provided in a written document signed by an authorized representative of Tilting The Balance, LLC. No communication, conduct, or action by the Company shall be interpreted as a waiver unless explicitly stated.

27. FORCE MAJEURE

Tilting The Balance™, LLC shall not be liable for any failure or delay in performing its obligations under these Terms or in providing any products or Services if such failure or delay is caused by events beyond the Company’s reasonable control, including but not limited to:

• Acts of God

• Natural disasters
• Fire, flood, hurricanes, or storms
• Pandemics or public health emergencies

• War, terrorism, or civil unrest

• Governmental actions or restrictions

• Power outages
• Internet or telecommunications failures
• Hosting or server outages
• Failures of third-party service providers (including payment processors, email platforms, or software providers)
• Supply chain disruptions
• Labor shortages or strikes

In such circumstances, the Company’s obligations will be suspended for the duration of the event, and the Company shall not be liable for any resulting delays or inability to deliver products or Services.

REFUNDS, RETURNS, AND GUARANTEES POLICY

Thank you for choosing Tilting The Balance™, LLC (“we,” “our,” or “us”). We are committed to delivering high-quality books, programs, coaching, and digital resources that support lasting balance, growth, and transformation. This Refunds, Returns, and Guarantees Policy explains how refunds, returns, and satisfaction guarantees apply across all products and services we offer.

By purchasing from us, you agree to the terms below.


1. Books (Physical and Digital)

1.1 Physical Books

All sales of physical books are final.


If your order arrives damaged, defective, or incorrect, notify us within 7 days of delivery at [email protected] and include:

Your order number

A photo of the issue

A brief description

We will issue a replacement at no additional cost.
Replacements are the sole remedy for issues with physical books.

1.2 Digital Books and Files

All digital book sales are final, including:

PDFs

eBooks

Downloadable workbooks

Audiobooks

Digital items cannot be refunded once delivered or accessed, except in the case of a verified technical delivery issue.

2. Online Courses and Digital Programs

All course and program purchases are final because digital content is accessible immediately.


If you are unsatisfied, you may request a review within 7 days of enrollment.

Refund requests must meet all of the following conditions:

You contact us within 7 days of enrollment.

You have not downloaded more than 2 percent of course files.

You have not completed more than 2 percent of course modules.

You have not used or requested any bonus coaching sessions.

Refunds will NOT be granted for:

Change of mind

Failure to participate

• Incomplete progress

Inability to attend live sessions

Purchasing mistakes

Technical limitations on the user’s device

Refund approval is at our sole discretion.

3. Coaching Services (One-on-One or Group Coaching)

Coaching is a professional service and not a digital good.

3.1 Refunds Before Coaching Begins

You may request a full refund only if:

No coaching sessions have been delivered, and

The request is submitted within 7 days of purchase

3.2 After Coaching Has Started

After your first scheduled session, all payments become fully non-refundable, including:

One-on-one coaching

Group coaching

Accountability calls

Coaching bundles or packages

Bonus or promotional sessions

3.3 Rescheduling and Pausing

To reschedule or pause coaching, email [email protected].


We do our best to accommodate, but accommodations are not guaranteed.

3.4 No Guarantees

Results depend on your participation, consistency, and personal effort.


No outcomes are promised or guaranteed.

4. Physical Merchandise and E-Commerce Products

4.1 Damaged or Defective Items

If merchandise arrives damaged or incorrect, contact us within 7 days with:

A photo of the item

Your order number

We may replace the item or issue a refund at our discretion.

4.2 Non-Returnable Items

We do not accept returns for:

Incorrect sizing chosen by the customer

• Items returned without authorization

Items damaged through normal use

Items returned after 7 days

Sale, clearance, or promotional merchandise

5. 30-Day Challenges, Memberships, and Community Access

5.1 Subscription Billing

All subscription fees are non-refundable once the billing period begins.

5.2 Canceling a Membership

You may cancel anytime before the next billing date to avoid future charges.

5.3 Access After Cancellation

You retain access through your current paid period.


No prorated refunds are issued.

6. Satisfaction Guarantees

We guarantee the quality of our materials, but not your results.


We do not guarantee specific outcomes, including:

Income increases

Health improvements

Mental or emotional changes

Career success

Relationship changes

Personal transformation

Productivity changes

Your results depend on your consistency and personal circumstances.

7. Chargebacks and Payment Disputes

By purchasing from us, you agree:

You will contact us first before initiating a chargeback.

Filing a chargeback for a delivered or accessed product is fraudulent.

We may provide evidence to payment processors, such as:

IP logs

Login timestamps

Download history

Session history

Email or form records

Fraudulent disputes may result in:

Immediate loss of access

Permanent banning

Legal collection of owed fees

8. Non-Transferability of Purchases

All purchases are non-transferable.

This includes:

Coaching sessions

Digital downloads

Books

Assessments

Memberships

Course logins

Portal access credentials

Sharing or reselling access is prohibited.

9. How to Request Support or a Refund Review

Unauthorized sharing of credentials results in immediate termination

TILTING THE BALANCE™ — SHIPPING POLICY

Thank you for ordering from Tilting The Balance™, LLC. We aim to provide a smooth and reliable delivery experience. Please review the following Shipping Policy which explains how we process, ship, and handle all orders placed through our website.

1. Order Processing

Orders are typically processed within 3–5 business days after payment is received.


Processing times may be extended during:

• Book launches

• Pre-order campaigns

• Holidays

• High-volume promotions

If extended delays are expected, we will notify customers by email.

2. Shipping Methods and Delivery Times

We currently ship within the United States using carriers such as:

• USPS

• UPS

• FedEx

Estimated delivery time (after processing): 5–10 business days, depending on location and shipping method.

Delivery times are estimates only and may vary based on carrier operations, weather, or unexpected delays.

User agrees that some orders may be facilitated by print-on-demand services.

Print-on-Demand (POD) Orders

For print-on-demand orders, fulfillment may be handled by:

• Amazon (Amazon Logistics)

• Other approved third-party printing and fulfillment partners

Some of our books may be fulfilled through print-on-demand services such as Amazon or other third-party printing partners. When a POD service is used:

• Processing times may vary between 3–10 business days depending on the printer’s workload

• Shipping carriers may differ from our standard carriers and may include Amazon Logistics or other third-party delivery partners

• Packaging and delivery timelines are determined by the POD provider and are outside of our direct control

• Tracking numbers will be provided when available, but some POD services do not support real-time tracking

• Replacement requests for POD orders may require verification and processing through the POD provider's system

If your POD order arrives damaged or defective, please contact us at [email protected] and we will coordinate the replacement through the appropriate provider.

3. Shipping Costs

Shipping costs are calculated during checkout based on:

• Destination

• Order weight

• Selected shipping method

Occasionally, we may offer free shipping promotions within the continental U.S.

4. International Orders

International shipping is not yet available.


We are working to expand global delivery.


Please join our newsletter for updates when international shipping becomes available.

5. Tracking Information

Once your order ships, you will receive:

• Your tracking number

6. Damaged, Lost, or Delayed Packages

6.1 Damaged Orders

If your order arrives damaged:

• Contact us within 7 days

• Include a clear photo of the damage

We will work with you to arrange a replacement or refund when appropriate.

6.2 Lost or Delayed Packages

If a package is delayed or appears lost in transit, we will contact the carrier on your behalf to resolve the issue.

6.3 Packages Marked as “Delivered”

Once a package is marked as Delivered by the carrier, responsibility transfers to the customer.

We cannot replace or refund packages that are:

• Marked as delivered

• Stolen after delivery

• Misplaced after carrier confirmation

We recommend checking with neighbors, household members, or your local carrier office.

7. Incorrect or Undeliverable Address

Customers are fully responsible for entering accurate shipping information at checkout.

We are not responsible for orders that cannot be delivered due to:

• Incorrect address

• Missing apartment or unit number

• Refusal of delivery

• Failure to pick up from carrier

If the package is returned to us, the customer will be responsible for reshipping fees. Refunds, if issued, will exclude shipping charges.

8. Return-to-Sender and Undeliverable Packages

If a package is returned to us:

• Due to incorrect or incomplete address

• Due to refusal

• Due to failure to pick up

• Due to carrier inability to deliver

We will notify you and offer two options:

• Reship the order (additional shipping fees apply)

• Refund the order (if eligible), minus original shipping costs

9. Digital Product Delivery

For all digital items such as:

• PDFs

• E-books

• Audio files

• Bonus downloads

• Course access

• Assessments

Delivery is instant via email or on-screen link.


No physical shipment is involved with digital purchases.

Digital and physical products in the same order may be delivered separately.

10. Pre-Orders and Backorders

Pre-order items (including Tilting The Balance™ workbook and bundles) may have extended processing times.

You will receive:

• Estimated ship dates

• Periodic updates

• Immediate access to any included digital versions (when applicable)

All pre-order shipping timelines are estimates and may change due to:

• Printing delays

• Carrier delays

• Supply chain issues
